Jose Angel Garcia had recently moved from Kanas and was living in the Orem/Provo area during September of 2007. He was currently working at Precision Coatings in Springville through the temporary employment agency Spherion Temp. Precision Coatings, according to their LinkedIn page, “serves global healthcare and medical device companies around the world, coating medical devices such as guide wires, surgical instruments, orthopedic implants, and forming mandrels. We work with customers from concept to commercialization and have five facilities in Massachusetts, Rhode Island, and Costa Rica.”1 Angel had used the Spherion Spanish Fork office to sign up for the Precision Coatings job.
In September 2007 Angel had two girl friends, one of which was 15 years old and lived in American Fork. Angel at the time of this incident is 19 years old. This 15 year old girl friend’s mother worked at the local Sinclair Gas station in American Fork and tensions were high in the family because her brother was due to appear in court in the next few days. The second girlfriend lived in Provo.
Angel recently moved from Orem to Provo and is now living with his brother Gustavo Garcia, which is closer to his Provo girl than his American Fork girl. He has not seen his American Fork girl for several days.
On September 5, 2007 Angel was attending a birthday party with several friends, his girlfriend and her daughter. They were celebrating Otero’s Birthday, with food, drink, and some loud music. They were having BBQ chicken and drinking beer. Angel arrived at the party in his new dark colored 2006 Dodge Stratus that he had purchased three days before from a local dealership called Low Book Sales. The car still had the temporary tag and license frame carrying the name of the dealership.2 He was with one of his girlfriends.
After a while, and after several hours of drinking, the friends start making rhymes at each other. It is like a rap battle where they send insults to each other in the form of a rap. Angel and Sida become upset with each other as the rap battle continued. They were both about ready to fight when Otero told them no to fight at his house. “There are children here!”, he yells at them.
Angel then leaves the house with his girlfriend and her daughter to take her home. Sida and Otero have a discussion and resolved the issue they had with each other. When Angel returns after dropping his girlfriend and daughter off at her house him and Sida resolve the tension that was between them. They then continue to drink. Angel then offers to take Sida home and Otero decides to join them.
The three of them get into Angels car and drive to Springville to take Sida home. Angel knows the way well, he has partied there several times with his present company as well as other residents in the apartment complex that Sida resides in. The arguing continues the entire drive to Sida’s apartment.
