After Angel was found in Kansas and sent back to Utah for the attempted murder of Sida and the Aggravated Assault on Otero he was incarcerated in Utah to wait trail and sentencing. He is charged again with a different crime.
January 27, 2008 – Angel Garcia (21) assaulted a prisoner, a third-degree felony.
Angel was heading to his cell in the Utah County Jail in dorm area 11 when he wanted to give “the guy with the tattoo on the back of his neck” a hard time about being rolled up from the out program. Utah Jails offer what are termed out programs by the inmates. These programs consist of educational classes, vocational training, counseling, and rehabilitation services that are geared towards helping inmates reintegrate into society. When an inmate is rolled up from the out program it means that they are removed from one of those programs because of behavioral, security concerns, medical or mental health decisions, and administrative decisions. As Angel was talking trash to inmate Hamel, the inmate with the tattoo. Another inmate, Richard Glatzer (31) who was also recently rolled up from the out program and was currently serving time for possession of a controlled substance which he pleaded guilty to on December 05, 2007, noticed what Angel was doing.1
Glatzer then yells to Angel, “what the f*** you are looking at?” Glatzer then pulls down his pants exposing himself to Angel and says, “do you want to suck on this?”. Angel felt like he had been disrespected and wanted to retaliate then, but because it was 22:00 and the unit was locking down for the night he let it go. Angel thought about the incident all night trying to decide if he was going to let it go or not.
In the morning Angel was on breakfast duty and was serving breakfast at 6:30 in the morning to the other inmates. He notices Glatzer walking towards him, looking down at his tray, as he was walking to get a banana. Angel took advantage of the fact Glatzer was not paying attention and threw a sucker punch hitting Glatzer in the head. Glatzer retaliated by kicking Angel and getting a couple of punches in, hitting Angel’s arm and head.
Deputy Robinson hears the argument and fighting and comes over from the other lunch area. Deputy Jarvis responds as well and goes towards the fighting as he presses his duress alarm. They tell the rest of the inmates to return to their cells. Deputy Robinson orders the two inmates to separate. Angel and Glatzer continue to fight, ignoring Deputy Robinson’s orders. Deputy Robinson grabs Angel and pulls him away from Glatzer while still telling them to stop. Deputy Jarvis grabs inmate Glatzer. Deputy Robinson drops Angel to the ground and holds him until other Deputies respond to the duress alarm.
Both inmates are handcuffed, and Angel, being the instigator of the incident is then charged with assaulting a prisoner. Glatzer was taken to medical and was left there for a few days for observation.
