Offender Number: 184077 Jose Angel Garcia-Juaregui (Inmate #42807)

Angel was in the Utah State Corrections system from 03/03/2008 until he was paroled on 12/04/2012. His parole ended on 1/31/2014 when he was killed after a stand off with Utah police officers from several different agencies after shooting two officers.1

The following is a list of all of the interactions that were recorded between Jose Angel Garcia-Juaregui and Utah State Corrections. 2 This document was obtained by GRAMA request by Cedar Valley Sentinel for use in this work.

    “The Level of Service/Risk, Need, Responsivity (LS/RNR) was developed for public safety organizations who want to use the most current research when conducting their level of service risk assessment but already have a case management process that they are comfortable with. It assesses the rehabilitation needs of offenders, their risk of recidivism, and the most relevant factors related to supervision and programming. The LS/RNR combines selected assessment sections from the LS/CMI™ and makes them available in one easy form. The LS/RNR assessment captures General Risk/Need Factors including Criminal History, Education/Employment, Family/Marital, Leisure/ Recreation, Companions, Alcohol/Drug Problems, Procriminal Attitude/Orientation, and Antisocial Pattern. It also captures Specific Risk/Need Factors including Personal Problems with Criminogenic Potential and History of Perpetration, including sexual and non-sexual assault and other forms of violence and anti-social behavior. Special Responsivity Considerations are also included. The LS/RNR normative sample consisted of 157,947 North American youth and adult offenders — 60,156 American adult and youth offenders from 10 jurisdictions, and 97,791 Canadian community and institionalized adult and youth offenders.     While conducting a cell search a small plastic bag containing an ink like substance was found inside Angel’s deodorant Stick. The paraphernalia was confiscated and disposed of.
  • 08/23/2008 – Event
    Angel was out of his cell at 21:10. Lock down time was at 20:30 it was noted that Angel may of jammed the door so it would open, his cell door was not opened by staff.

    Angel scratched his right arm while reaching under a fence in the big yard to retrieve a handball that had rolled under the fence.

2009

  • 02/07/2009 – Event
    Angel was found out of bounds after lock down. At 21:30 he was found playing cards in the day room, lock down was at 18:00
  • 02/22/2009 – Event
    Angel altered his shoes, he tucked the high tops down and sewed them. It created a natural compartment to hide things. He was told to return them to normal or they would be confiscated.

    Angel was found out of bounds at 20:15 after 18:00 lock down.

    Angel volunteered to pass out supplies.

    Angel was out of bounds in the yard from 18:00 to 19:00 hours. He was also found faking a knee injury.

    Angel turned in an old key that he found while he was in the yard.
  • 06/25/2009 – Event
    Volunteered to operate as a translator.
  • 07/08/2009 – Event
    Out of bounds several times, he was asked “to rack in each time.”
  • 07/09/2009 – Event
    Out of bounds at 18:00 Angel was found in the yard playing soccer after a 16:30 lock down.
  • 07/12/2009 – Substance Abuse Test – tested negative
  • 07/14/2009 – Event
    One inmate put something down the back of Angels pants. He was asked what he was putting in his pants. After a pat searched a radio was found down the back of his pants. The radio was confiscated.

    Because Angel had received five negative notes in the last 10 days, he was referred to OMR.
    OMR = Offender Management Review – which is a review done by a committee.4

    Horse Play – Angel and another inmate were throwing punches and putting each other in head locks.

    Angle has been warned and advised to get a new identification card or he will not be allowed to visit. Angel returned with his old identification card.

    Angel received his 4 Step Offender Progress Folder.
  • 04/08/2010 – Reassessment – Angel kept at a C3K level.
    • C = Angel’s Lock Down & Out-of-Cell Level – 12-18 hrs/week (Structured Housing)
    • 3 = Advancement Review Level – 90 days before inmate is eligible to advance in Lock Down & Out-of-Cell Level

  • 05/18/2010 – Event
    Angel was seen playing poker and gambling in the dayroom.
  • 08/14/2010 – Event
    Angel had his cell inspection and failed.
  • 08/31/2010 – Reassessment – Angel kept at a level C3K
  • 09/12/2010 – Substance Abuse Test – tested negative
  • 09/17/2010 – Event
    Angel and other inmates were asked if they had any problems or concerns. Inmates replied negative, but several of them wanted shoes.
  • 09/20/2010 -Reassessment – Angel moved from C3K to C2K.
    The only change was his advancement review level, which now makes it so that in 60 days the inmate is eligible for a Lock Down & Out-of-Cell Level advancement.

    The Bonneville Community Correctional Center opened in the 1980s and has capacity for 74 male parolees. Its staff works to stabilize and transition parolees, including sex offenders and mentally ill offenders, to the community. In 2015, it began offering mentally ill offenders the BRIDGES course through the National Alliance for Mental Illness.6

    Angel is working for a company in Provo. He and his brother are looking to move to Spanish Fork in the next month. Reminded of 90 day curfew. Angel seems to have a good attitude. Asked to bring paycheck stub each month when reporting to the office.

    Angel claimed to not be using elicit drugs, alcohol or abused prescription medications since last time he saw his probation agent. Still working and probation officer has all the information.

    Angel was on time to appointment. Supervisor had received two NORM envelopes with “return to sender”. Corrected address and gave Angel two NORM envelopes. Angel showed full-time paycheck stubs to validate employment. Curfew has been removed.

    Angel was early for his appointment and has completed all special conditions of his parole with the exception of his legal obligations. Employment has changed. Angel reports he is fixing up a Cadillac passenger vehicle that needs to be added to the DOC database once it is up and running.

    Parolee Progress:
    Angel obtained lawful full-time employment upon his release from custody. He has had three different employers since being paroled in December 2012. Angel has not been referred to the Utah State Board of Pardons and Paroles for an alternative event or parole revocation proceedings during this parole.
    Angel currently owes supervision fees in the amount of $406.99. He has made no payments towards his financial obligations. Angel has also agreed to sign a Waiver of Personal Appearance to amend his parole stipulations. Angel is asked to pay $8,233,90 in restitution to the office of Victims and Crime, formerly Crime Victims Reparations.

    Violation of standard condition number seven of the Parole Agreement. Failed to establish, reside at, or changed without prior AP&P approval the residence of record.
    Violation by committed a new criminal offence, or failing to notify AP&P within 48 hours of contact with police officer regarding an investigation, arrest, or new offense.

    Asked about Draper incident. Angel stated he ant the owner of the home got into an argument and he left the house. Denied gun was involved. He was told he cannot go bat to the home. Angel claims he got a concussion at the house after hitting his head on a door and hasn’t been able to work. His vehicle was not able to be searched, Angel stated it was out of gas and a friend drove him to the office.

    Def paroled from the Utah State Prison for the first time on 12/04/2012. He transferred is parole to Salt Lake from Provo on approximately 12/10/2013. On 1/29/2014 the Board issued a warrant for absconding, failing to establish residence or record and employment. On 1/30/2014 Angel was involved in a shooting where he shot and killed a Utah County Sheriffs officer and wounded a Juab County Sheriffs office. Angel was also wounded and died of his injuries on 1/31/2014. The board recalled his warrant and closed his case on 2/27/2014.
